V. David Rivkin
Beginning in commercial litigation, David Rivkin’s business law practice has evolved over the years to include acting as outside general counsel and advisor for a broad range of business enterprises; structuring, negotiating and documenting corporate and other transactions; negotiating and drafting varied commercial agreements; providing for the legal needs of business startups; and counseling on intellectual property matters including trademark, trade secret, copyright and domain name protection.
Mr. Rivkin’s recent corporate projects include:
• Representation of franchisee in negotiating, structuring, financing and documenting state-wide franchise in the home improvement industry.
• Negotiating and preparing key research and development agreements and manufacturing agreements for a high-technology company;
• Advising an executive placement firm on multiple internal employment related matters, fee agreements with its clients, and acquisition of new office space.
• Drafting and negotiating information services agreement with third party provider on behalf of a financial advisory firm.
• Successfully prosecuting numerous trademark applications with the U.S. Patent and Trademark Office on behalf of multiple clients.
Mr. Rivkin has recently handled high-profile and complex commercial litigations including:
• Defense of a steel distributor in lawsuit brought by competitor, raising novel issues of law on scope of civil RICO; the case was successfully argued for the client before the United States Supreme Court.
• Prosecution of copyright infringement claims involving software, resulting in multi-million dollar settlement on the eve of trial.
• Defense of a major international sports federation in breach of contract action brought by a leading credit card company, in which the Second Circuit Court of Appeals reversed and vacated adverse trial verdict by the district court judge.
• Successful representation of a prominent foreign clothing manufacturer in arbitration proceeding before the World Intellectual Property Organization concerning unlawful registration of client’s internet domain name.
Before beginning his legal practice, Mr. Rivkin was the Director of Operations at a New Jersey-based television/radio company. His hands-on business, management and financial background, combined with his broad business counseling and commercial litigation experience, enables him to advise clients on a practical as well as legal basis, focusing on the client's core business objectives when crafting effective legal solutions.
Mr. Rivkin received his J.D. in 1999 from Yeshiva University’s Benjamin N. Cardozo School of Law and his B.A. in 1992 from the University of Arizona. He is admitted to practice in the State Courts of New York, the United States District Court for the Southern District of New York, the United States Court of Appeals for the Second Circuit, and the United States Supreme Court. He is also fluent in Russian.
