Litigation and Dispute Resolution

Our attorneys have extensive experience in successfully resolving complex and sophisticated disputed matters for our clients in U.S. and international litigation and arbitrations, with substantive expertise that includes commercial contracts, government contracts, securities and other frauds, employment discrimination, reinsurance, art and artists’ rights, injunctions, enforcement of foreign discovery and judgments, RICO and class action prosecutions and defense. We customarily handle the litigation and arbitration needs of our international and domestic corporate clients.

Much of our litigation work for corporate clients has included a substantial international dimension. In recent contested matters our litigation attorneys have represented: a French financial services company in a federal civil RICO fraud action; a Canadian manufacturer in a dispute arising out of a U.S. Navy contract; individual and corporate U.S. parties in a dispute arising out of a joint venture for a Latin American investment fund; Latin American parties in a dispute in federal court arising out of the acquisition of a Latin American financial institution by a U.S. bank; a Spanish-based pharmaceutical company in proceedings in Spain; a U.S. multinational bank enforcing loan obligations in concurrent court proceedings in New York and Venezuela; and a world-wide class of defrauded investors in a failed hedge fund in a securities fraud class action and concurrent cross-border bankruptcy and liquidation proceedings. Our litigation matters regularly involve jurisdictional or forum non conveniens objections, prejudgment attachments, obtaining evidence abroad, bilingual depositions and bilingual court testimony. We are regularly called upon to assist foreign lawyers and litigants in obtaining or limiting discovery sought in the U.S. for use in foreign proceedings.

Complementing our general litigation capabilities, the firm has developed special expertise in two niche areas. The first is in representing museums in the recovery of stolen art and artifacts. The second is advising business clients and representing them in defending court and other proceedings concerning allegations of sexual harassment, age, disability and other employment discrimination and workplace disputes, as well as in enforcement of employee non-compete agreements.

In the important area of alternate dispute resolution, we have extensive experience in arbitration before U.S. and foreign arbitral bodies. Many of our attorneys have served with distinction as neutral arbitrators or have advised entities such as the World Bank in the establishment of procedures for the settlement of international investment disputes. Our attorneys have also represented domestic and international clients as their counsel in prosecuting or defending claims before arbitration panels.

Drawing upon our government service experience, international perspectives and cross-cultural communication skills, we have also negotiated and resolved disputed litigation and regulatory matters for individual clients including contracts, partnership disputes, trusts and estates, and professional discipline matters.
